These Terms and Conditions govern the relationship between the entrepreneur Miroslav Filipovič (ID: 05943027) and the client. This website does not serve as a classic online store. All presentation of diamonds is for informational purposes only, and submitting an inquiry form does not constitute a binding offer to conclude a purchase agreement.
The provider exclusively arranges individual imports of natural rough diamonds based on the client's specific requirements. A purchase agreement is formed only after a personal consultation, determination of specifications, and the signing of a printed or electronic purchase agreement.
Payment for the goods is conducted in two stages. Upon confirmation of the diamond's specifications and the signing of the agreement, an advance invoice for 25% including VAT of the estimated purchase price will be issued to the client, unless otherwise agreed individually. This deposit serves as a binding reservation and initiates the import process. The final purchase price is determined immediately before the final payment, based on the precise physical weighing and confirmation of specifications of the specific diamond. The final balance is payable after a physical inspection of the stone by the client (or an authorized expert). The payment method (bank transfer) and the location of presentation and handover are subject to individual agreement and strict security standards. The buyer becomes the owner of the goods only after the final payment and at the moment of handover and acceptance of the subject of purchase based on a handover protocol signed by both contracting parties.
In accordance with applicable legislation (Act No. 253/2008 Coll., on Certain Measures against Money Laundering and Terrorist Financing), the provider is obliged to identify and verify the client. The client agrees to provide the necessary cooperation (presentation of an identity card, proof of source of funds for higher amounts). All diamonds come from legal sources in full compliance with the Kimberley Process.
Given that the subject of performance is the supply of custom-made goods and individual import, the conditions for withdrawal from the contract will always be negotiated individually within the specific purchase agreement. These individual agreements take precedence over general provisions. Unless otherwise agreed by the parties, for goods customized or imported according to the consumer's specific wishes, it is not possible to unilaterally withdraw from the contract under the applicable legal provisions (Section 1837 of the Civil Code).
